Disclosure policy
Disclose the relationship.
Top rule: any time you publicly recommend HelpRent Phangan and stand to be paid for it, the reader must see that this is a paid partnership. Before the click. On the same screen. In the same language as the post.
Acceptable wording
- English: "ad", "advertisement", "sponsored", "paid partnership with @helprentphangan", "in collaboration with HelpRent".
- Russian: "реклама", "партнёрский материал", "оплачено HelpRent Phangan".
- Thai: "โฆษณา" or "ได้รับการสนับสนุนจาก HelpRent Phangan".
Per-platform requirements
- Instagram / TikTok / YouTube: use the built-in "Paid partnership with @helprentphangan" or "Includes paid promotion" tag — a #ad caption alone is NOT enough if the platform offers a native disclosure mechanism.
- Telegram / WhatsApp / Facebook posts: add "#ad / #partner" in the first line of the message, above the fold.
- Blog / longform / Substack: explicit "This is a paid partnership" banner at the top of the article.
- Stories / ephemeral posts: add the "Paid partnership" sticker — by default these posts have no disclosure.
- Email / DM on request: mention "I get a referral bonus if you book through my link" in any personal recommendation.
Legal basis
- EU UCPD (Directive 2005/29/EC) + Digital Fairness Act 2025: hidden advertising = unfair commercial practice. Fines up to 4% of brand's annual turnover (not the partner's).
- Thai Consumer Protection Act B.E. 2522 + Direct Sales and Direct Marketing Act: deceptive advertising — up to THB 200,000 fine + up to 6 months imprisonment.
- FTC Endorsement Guides (16 CFR Part 255): applicable if you have a US audience, even if you aren't in the US.
Audits
We periodically audit partner posts. A missing disclosure is grounds for a warning; a repeat violation triggers programme suspension and withholding of unpaid commissions.
